Membership Loyalty Points User Agreement

Gym Name: Gold's Gym Tampa Gas Worx

This Membership Loyalty Points User Agreement (“Agreement”) sets forth the terms and conditions of participation in the Loyalty Points Program (“Program”) offered by Gold's Gym Tampa Gas Worx (“Gym,” “we,” “our,” or “us”). By enrolling in or participating in the Program, the member (“Member,” “you,” or “your”) agrees to be bound by this Agreement and all applicable Florida state laws.

1. Program Eligibility

1.1 You must be an active, paid gym member in good standing.

1.2 You must be at least 18 years old to participate.

1.3 Enrollment in the Program is voluntary and offered at no additional cost.

1.4 The Program is valid only in the State of Florida and may be subject to local regulations.

2. Earning Loyalty Points

2.1 Members may earn loyalty points (“Points”) through qualifying activities, including but not limited to:

Check-ins/workout visits

Training purchases

Class attendance

Participation in challenges or promotions

Birthdays

Membership Anniversary Dates

Member Referrals

2.2 Points have no cash value, are non-transferable, and may not be sold, bartered, or used as credit toward monthly dues unless explicitly stated in a promotion.

2.3 We reserve the right to determine which activities qualify for Points and how many Points are awarded.

3. Redeeming Loyalty Points

3.1 Points may be redeemed for eligible rewards through the Perkville program within the app and any other rewards specifically outlined therein.

3.2 Rewards are subject to availability and may change at any time.

3.3 Points cannot be redeemed for cash or used to satisfy outstanding account balances.

3.4 Once redeemed, Points are deducted from your account and cannot be reinstated.

4. Points Expiration and Forfeiture

4.1 Points expire 12 months after they are earned unless otherwise stated.

4.2 Points are forfeited if:
Your membership is canceled
Your account becomes delinquent
You violate gym policies or program rules

4.3 If you reinstate your membership after cancellation, previously earned Points will not be restored.

5. Membership Status and Account Requirements

5.1 You are responsible for ensuring your contact information is accurate and up-to-date.

5.2 You can view your Points balance through:

The gym’s mobile app

Your online account

5.3 The front desk is not responsible for missing points at at no time will make modifications to your points balance. Gold's Gym staff does not manage, modify or edit points account balances.

6. Program Changes, Suspension, or Termination

6.1 We may modify, suspend, or terminate the Program at any time, with or without notice, to the extent permitted by Florida law.

6.2 If the Program is terminated, unredeemed Points may expire immediately unless required otherwise by applicable law.

7. Florida-Specific Consumer Disclosures

7.1 This Program is promotional in nature and not a gift certificate or stored-value program under Florida Statutes Chapter 501 unless otherwise mandated by law.

7.2 We comply with all applicable Florida consumer protection and health club regulations, including Florida Statutes §501.012–§501.017 (health studio regulations).

7.3 Participation in this Program does not change or modify your rights under your gym membership contract required by Florida law.

8. Privacy and Data Use

8.1 Information collected through the Program is used in accordance with our Privacy Policy.

8.2 Your data may be used for:

Reward tracking
Providing personalized offers
Program administration

8.3 We do not sell personal information to third parties.

9. Limitation of Liability

9.1 The Gym is not liable for:

Lost or stolen Points
Unauthorized access to your account
System errors, outages, or technical malfunctions

9.2 To the maximum extent permitted by Florida law, our liability is limited to the actual value of the Points in dispute (which is zero, as Points have no cash value).

10. Governing Law & Dispute Resolution

10.1 This Agreement is governed by the laws of the State of Florida.

10.2 Any disputes shall be resolved through:

Informal negotiation first

If unresolved, arbitration or small claims court as permitted by Florida law

11. Acceptance of Terms

By participating in the Loyalty Points Program, you acknowledge and agree that you have read, understood, and accepted the terms of this Agreement.
